They have clearly broken the law, but are probably calculating that by the time it is sorted and they're fined or whatever, the savings will have paid for any sanctions. One clear aspect of this awful event is that P&O are absolutely wrong to describe what they're doing is redundancies. A redundancy is about the job no longer needed being doing any more, but they want to hire cheaper agency people to do the job...that still exists! The action is about an attack on the individuals, not the job they were doing, which i am pretty sure breaks employment law. The ability of trade unions to act has been gradually diminished, or made much harder, since the days of Thatcher which has led to this fire and re-hire culture. Will this government enact, or toughen up present, legislation to protect workers from this kind of appalling treatment? I doubt it because this present government associates Trade Unions with dastardly advances such as sick pay, maternity leave, paid holidays, health and safety measures, meaningful consultation with workers, and paying said workers at a decent level. It is absolutely because of this kind of behaviour by P&O and it's non domicile parent company that makes me, for one at least, glad to hear of industrial action by organised workers anywhere, yes even train drivers. You go to work this morning, your life and near term future sorted as best as anybody is able, and you get an internet message that tells you to leave immediately. The company saying eff off and we'll see you in court.
This is absolutely shocking behaviour and totally illegal. No consultation. No warning. No nothing. It also sets a precedent and if the Government does not take immediate action then it will open the floodgates for other unscrupulous companies to do exactly the same thing.

Not sure that your first sentence is correct. It depends on where the ships are registered and were the employment contracts are signed. The shipping industry is completely international and the British merchant navy has been decimated over the last 20 years by actions similar to P&O Ferries. I speak as someone who was employed in the UK shipping industry throughout my working life

Downing Street said the Government was not given any advance notice by P&O of the company's plans.
The Prime Minister's official spokesman said officials were in “urgent” talks to find out what the company's plans were.
“We weren't given any notice to this. We are speaking to the company to understand what approach it is taking,” the spokesman said.
“We do not agree with the practice of fire and rehire and would be dismayed if this is the outcome they were seeking to achieve.”
The spokesman said he did not believe the issue was discussed when Boris Johnson was in the UAE on Wednesday, even though the company is owned by Dubai-based logistics giant DP World.
Why would Johnson raise this? It doesn't affect him after all.
As others have said P and O have clearly made a decision that any savings they make will cover the costs of any legal battles. No company that size would come to a decision like this without seeking plenty of legal advice first, whilst they are more than likely breaking employment law they are clearly hedging their bets that the savings outweigh any costs which might come from court action.
However if anyone has happened to watch the 3 minute pre recorded video of the Chief Executive laying everyone off he is very clear everyone will get enhanced redundancy packages....... If they sign a settlement agreement. Which will no doubt include an agreement not to take any legal action against P and O.
They are clearly hoping that their employees are going to be so financially stricken by being laid off with immediate effect that there'll sign whatever is in front of them as they know most staff will be like the majority of the working class population in the UK, living month to month and pay cheque to pay cheque.
It is all well and good saying employees should take collective action and fight against this but when people have families to feed you will no doubt see many being forced into signing these settlement agreements because they can't afford to wait for the outcome of any legal battles.
As others have said an absolutely disgraceful way to treat a workforce. So much scheming and deceit has clearly gone into this whole operation but one thing that sticks in my mind is the fact they have clearly pre-booked handcuff trained private security guards to eject colleagues from the ships, moments after laying them all off with immediate effect via a pre recoded video message.
The only thing I will add is to anyone considering using P and O again, if that is how they treat their workforce imagine how they treat their customers.
I would hope the Union would help with financial support until court action. For 800 though, that will be tough unless the wider Union movement can pitch in. I don’t know the legalities mind you, and how that might impact on unemployment claims.
