Sheriffs

Anyone had any experience using them, a relative is having some issues. The debt has gone to £4300, and they have paid £1300 in the last two days. They are threatening to remove their stuff unless they stump up £1600 today. They cant get this and so are worried. The sheriffs have been in and made an inventory list so can take possessions away.

  • Once it gets to this stage there isn't much you can do, but pay them the money. Were there letters sent, and replied to, and did anyone attend court proceedings?
  • I think it is not too late to come to a payment arrangement with them, but don't keep to it and your stuff is gone without the need for further legal approval.
  • I'm sure that if they haven't got a court order to enter the property , there is nothing they can do without said documents . they cant force entry unless a door or window is left open .
    I may be wrong but that's my understanding .
  • If it is a high court sheriff, they are directed by the court to recover the money or seize assets to the value of.
    Personally speaking I would pay up, they will take a credit card or cash.
    If they do seize goods you will get a very poor return, as these will go up at an auction.
    Best to try and come to an arrangement if you can , and I would not hang about.
  • if you dont mind me asking, how long has the debt been unpaid and what is it for?

    got a mate who owes some money on a loan and its gone to debt collection, he gets the standard cowboy letters about someone coming round his house to collect the money, but he tells me most money forums say they are false threats. Be interesting to know what sort of debts call in Sheriffs.
  • As it happens ...... to use a 'Jimmy Saville' phrase I have issued a small claims action which cost me £80 for a judgement of £1,350. plus the costs.
    The whole small claims 'procedure' has changed, this gets sent off to Salford and they direct a local county court, probably Dartford. Quite what Woolwich county court does I have no idea.......
    Anyway, you then can proceed to a high court for another £80 and they issue the summons. It of course also screws up there 'credit history'.
    Court's can be strange places, you have to be very clear, and certain of your case. The judge will establish the facts for trival or unreasonable claims.
    Having worked in the high court as a reporter 40 years ago, I have seen a few 'clever dicks' come unstuck, even with decent representation.
    I have had to use the small claims a couple of times, and it was a very informal and fair proceedure.

    I may be wrong but that's my understanding .
    A high court sheriff may not be able to 'force' an entry but if you answer the door when they knock and they get a foot in, anything beyond that is not 'forcing' entry.

    I used to work with high court sheriffs on a daily basis and the different methods they can use to get into a property without and 'force' can be quite eye opening.

    To really be able to say what your friends can do we'd need to know if there is a CCJ (I assume there is) and when the inventory was taken.

    You insisted he must have BORROWED money in order to be in debt, that is simply not the case.

    Looking at your above post it is you who needs to read a dictionary.

    As for factory workers, don't make me laugh, I only hang with the rich kids.
