Copyright Claim By The Football League

Just to advise you that there has been a copyright claim submitted by the football league regarding the Hartlepool video which I uploaded onto YouTube. I have also been warned that if i do anything similar in future then my account may be deleted.

Having said that all other existing videos are still viewable on YouTube.

Does anyone have any idea about this because its not the football leagues footage so how can it be copyright, its my own. Also I was under the impression that because i am not gaining financially and footage is taken from a mobile phone then there was no issue. Its obviously just a bit of fun and this seems a little OTT but does this now mean that every single football related clip on you tube has to be removed, which is obviously millions.

Would be interested to get your take on this.

  • The football authorities are very hot on copyright, after all image rights bring in a lot of money. Don't know what coverage they have over images of matches but as there used to be a condition of watching a match that you were not allowed to take photos then there is prbably some sort of clause in the terms and conditions of buying tickets covering copyright. still sounds OTT though

    clearly a bit of fun, and more documenting the "day out" than the actual in-play events on the pitch... for starters you're clearly using a phone from the stands looking at a postage stamp view of the action... what's the point? Don't they have better things to do like try and negotiate the terms of their broadcasting contracts a bit more stringently ;-)

    So they have removed it without any investigation, but is it copyright? Its my own footage and im not gaining financially or do they think that every football fan in the country is gonna tune in to my footage and not the tv, absolute twats...It takes me about 6-10 hrs to produce these videos. And why are the others still available but not the Hartlepool one, do you think they are pissed cos of the streaker bit!! Seems very strange however i suppose i could set up a Facebook page and upload onto that instead

    So that may be the end of that little hobby but im gonna email youtube and fight it as far as i can, iv informed the club anyway so they are aware.
  • Yes, the Clubs and the FL own the copyright to Football League matches which are sold to TV, Radio, Internet and the press collectively.

    Shame as it is a bit of fun for you and people who watch them but they will see it as the BBC, Sky and overseas companies pay a lot of money for the images and you don't.

    This has been going on for a while and a lot of British football clips have been removed.

    Take it as a compliment. You been noticed by the Football League.
  • I wouldn't bother emailing YouTube, your ticket will have clearly stated (in the tiny fine print) that you can't video or photograph the action. It may be your footage, but it's of an event organsised by somebody else, and it is they who own the rights (which they've subsequently sold to sky) to filming it. The fact you're not making a profit out of it is neither here nor there in the eyes of the law. There may be a personal use provision in the law (I doubt it though), but posting it on a public website negates that.

    If the match happened in a public space then there wouldn't be a problem, you can record what you like. But it's held on private property and the copyright to the on-field action is held by the football league.

    Unfortunately there is very little difference, in the eyes of the law at least, in filming the game from the stand, than standing in front of the telling and filming a sky broadcast of the game.

    Any using the fact the picture quality is poor because its a phone isn't likely to get you far. Firstly because copyright law doesn't make any provision for the quality of the copy, and secondly because at the rate technology improves, any making of camera phones exempt would quickly result in decent camcorder quality vids being produced (some high-end phones can already do HD recording at decent framerates)

    Must protect multi l international corporate companies from there right eh....... after all they have paid for the rights for these.......
    Christ 3rd division football and we are squabbling over 'rights' ..... perhaps the club should be paying the punters for watching it!....

  • Just spoke to the club regarding this and the official take is that no recording equipment can be taken into the ground except mobile phones for personal use, the football league own the copyright. I can film whatever i like within the stadium as long as i dont film the pitch (that should be interesting then lol).
    Im gonna continue because since the first one at Yeovil i vowed i wouldnt stop until the team lost, however im probably going to have to set up a Facebook page and see if i can get them on there instead, i dont want to be shut down by you tube as i use that tool to network my work related videos.

    Wonder why the others are still on there though, the club think it may have something to do with the streaker which has raised the profile of that particular video.

  • Could be the pictures used in the Video which are under some sort of copyright? Not based on the footage. I loved the video as the others and hope this doesn't put you off doing them.

    The Football League and the F.A. always like to step in and just be a pain Tony Kempster ran a non-profit great website dedicated to Football mainly non-league and had fixtures of all the leagues the Conference and below were fine being published on the website as it was well known, but Premier & Football League wanted 9,000 off Tony for the fixtures to be on his site.

    Would like to know the reasons behind it, Try Facebook :).

  • I was gonna write to the FL but wont bother as it will just highlight the others.

    One other solution could be to set up a non profit website and upload the videos and hope they arnt discovered, but if they are then it will be the same story..If they go online then im breaching the rules and regs and that wouldnt do would it? JOBSWORTHS
  • It's not the taking of videos and pictures that's the problem, it's the publishing of them...

    As long as you keep the material for your own personal use that's ok, start putting them on Youtube etc and you're breaking copyright laws...

    And BFR, you're wrong about AFKA's predictions competition, you're only allowed to print the fixture of the club you support and even then you need the club's permission...

    You can only freely list matches once they are underway...

    There's a big test case going on right now in the European Courts about prediction leagues and printing of fixtures etc., the football league is stating that betting companies are breaching copyright by printing fixtures of football games whilst the bookies are stating that under the European Data laws future fixtures do not count...

    The bookmakers have won their case hands down but then the football league found some long defunct rule used half a century ago to ensure the pools companies paid for the priviledge of printing weekly fixtures...

    I wouldn't mind but the betting companies such as Ladbrokes and Hills have already paid millions of pounds voluntarily to the football league but you might know what a set of greedy basterds the football league are...

    Unfortunately these videos seem to have been caught up with the general sweep for all breaches of copyright of football matches.

    We all know that live football is screened illegally on the internet or shown on via dodgy satellites in pubs.

    And as rights to broadcast games are so valuable to the Premier and Football league they employ agencies to crack down on ANY breach of copyright.

    Not disagreeing that it is breaking a butterfly upon a wheel but that is the reason. The FL are protecting their copyright so they can protect their main asset.

    Their argument is that if people can watch highlights for free on You Tube etc then TV companies such as Sky and the BBC will expect to pay a lower price or none at all.

    Take it as a compliment that you were big enough or had enough hits to attract their attention. Do what you said and take it under the radar via facebook or some other medium

  • Personally I find the BBC's 10 to 15 second highlights of weekend games only. far more interesting & insightful than the extended coverage of the reality of following CAFC that you tube cafc was posting for us ex-pats...I only hope the Beeb reduce our coverage further & have that dizzy bird read out more inane texts and e-mails from Newcastle fans instead....tosspots.

    Totally relevant as that just proves what I am saying. Copyright is about the "right" to do what you want with an image etc

    If the BBC choose to put trailers etc on you tube to advertise programmes etc (film companies do as well) then that is fine as they own the copyright. You Tube Addick doesn't own the copyright.

    Come on Ken, you're a journalist. You know more than most of us how it works. If I remember we've had copyright law in the UK since about 1701 so not really a new concept.

  • Obviously the BBC has the 'secondary' rights to show this that is why it is on 'i player' and allowed to show live games as they have done this week on MOTD.
    Copyright law from the UK is overidden by EU law in most cases Henry, remember when those of you who voted for that way back when!
    The BBC has for two years posted content on you tube and intends and has posted content as part of it''s digital archive.
    As a content producer myself for the BBC I have no issue with this and I have not found too many programme makers at the bbc who get upset at there content being shown. In fact John Lloyd of Black Adder fame was demanding for the content to become avaialable on you tube. I think it might have to do with 'rights' and Mr Murdoch re football,
    (Yes we all know about the pubs that show live games on a Saturday) Come on Henry just because I work at the BBC does not mean that I agree with there practices, or there coverage!

    As a photo journalist I have had my work used on you tube ..... which I take as a compliment as a fan, but then again if people wanted to sell the stuff..... well Messrs Sue Grabbit and Runn would come out of there box, after all as you argued on Sols posting it is my 'image rights' my copyright etc etc.... Just wish I had a fraction of the money he had, I certainly have the talent! ( and the solicitors)

  • I'm wondering if the football league have got the hump with your video because you have put up part of the league table at the start of the video. or because you have captured the Wagstaff goal so well, where's as in other videos the goals scored havent been as clear. A joke really as there is millions of clips on you tube exactly the same.

  • Just wondering why this particular video has been removed, there are 3 major differences between this and the others.....

    1. The League Table That Was Published At The Start Of The Video
    2. The Clarity Of Wagstaffs Goal
    3. The Streaker

    Dont think it would be the images as they are owned by the club

    Surely if it was just the match footage then not only would the vids have been removed, but every fans football vid on youtube, millions. Also what about filming at concerts and anywhere else on private property of an event that has its copyright owned by the company involved...its an interesting one

    I turn the new facebook group into a group specifically for fans to upload their own mobile video clips, this should be fine

    Personally I feel this just helps underline why the Football league is a tired and outdated jaded organization. Based on their ridiculousness most of the videos on Youtube shouldnt be on there. All power to you You tube cafc- maybe they are pissed off that your output knocks a lot of their 'official partners' tired old efforts into a cocked hat! Amazing world we live in!
