Before we all get our knickers in a twist my reading of this is that a) he got sentenced for throwing flares about along with kicking off at the old bill and b) the fact it got sent up to crown court means he's got previous that the magistrates felt required a longer sentence than they were able to dish out.
If you read the actual article (not the one Oxford put out) he was actually sent down for a number of things and the smoke bomb bollocks was just part of it, main thing was resisting arrest I think. Just Oxford have Made out it was only the smoke bomb thing to suit their agenda

In case anyone thinks it's OK to throw smoke bombs - they caused scorch marks on the pitch - therefore heat.
Still an offence to even bring one into the ground - anything that has a chemical reaction that creates heat is dangerous and the container can also cause injury if it hits someone.

It even goes further than that. If you are caught in the vicinity of the ground and there is reasonable evidence that you are going to the match, such as possesion of a match ticket, you can still be done.

Unacceptable, pathetic, disgusting and indefensible behaviour in my view.
