Youtube take down any football league footage

Got a message from Youtube saying they have deleted the three video clips of  Charlton goals i took with my camera , due to copyright infringement. They have also sent me a very patronising message saying what would happen if i post any football league clips again.
 If anyone has Charlton Videos on YouTube expect them to be deleted.

    There are threats of court action if i post copyrighted clips again plus my account will be deleted. They even give you a cartoon clip called " Copyright School" which you have to watch and answer questions before you can get access to your account.
    It felt like i was back at school. 
    I wouldn't mind but they were only crappy little clips i took with by camera phone!
    I cant help but feel that things like this will backfire on them big time.
  • That's pretty bizarre given the recent court ruling on the "Sky with a Greek decoder" issue which expressly stated that the games themselves were not copyright-able (is that word?) but that replays, graphics etc were. I'm guessing you didn't have any graphics on your camera phone images!!

  • I think @Choice got all his taken down a little while ago with the same threat.
  • Even though it won't get you much I'd be tempted to reply to YouTube asking what is actually being infringed. That message doesn't mention copyright, and as of the recent court case we know the footage can't be copyrighted. You are technically infringing the terms of your entry to the ground, but that is between you and the stadium owner/operator, and YouTube shouldn't be taking down the video without a court order, and certainly not at the request of a third party (the football league don't operate the stadium and your contract of entry is between you and the stadium operator).

    The football league may be less inclined to spew out all these take down requests if somebody pushes back. I don't think any club would be that interested in trying to get a civil case through the courts to force the removal of the video.
  • From what I understand the individual clubs are not that bothered, it is FLinteractive who are hot on this and trawl things like YouTube to protect their 'product' which they financially benefit from though the Player network.

    The same stupid rules that Football Dataco enforce ensuring websites can't publish fixture lists, league tables etc.

    All pretty pathetic sadly.

    As mean and as unfair as it maybe its up to Youtube if they want to take down material, after all its their site.  If they are misquoting the reason, i.e. its not copyright, its a different issue.  If they disagree with the Football league regarding copyright law then they could always take it to court and pay a large legal bill, which I am pretty sure they are not interested in doing.  If I ws them and they were being threatened with the potential of a football league injuction which would cost them money to defend I would do the same as them.
  • Really needs somebody to test these things in a court of law. Fixture lists really shouldn't be copyrightable, they are just a list of facts, and not a very long list at that!

    And as I say above, the Football League have no legal standing to have YouTube take those videos down. There is no copyright infringement happening, and by taking the video you are breaking your contract with the stadium operator, nobody else, so only they have any legal standing to take you to court for violation of the terms of that contract. Only after winning such a court case would they have any right to approach YouTube to get the video taken down.

  • Regardsing the fixture lists thing - surely someone should be able to come up with an inventive way of challenging that? How about posting fixtures with names of clubs slightly changed from the originals? Monchester Utd or Loverpool anyone? Used to work for PES back in the day.

    It's all pretty sad and pathetic, really - copyright protection in the digital age always takes on the appearance of fiddling whilst Rome burns.

    Well if the clubs have signed up to something so ridiculous they should at least inform the fans.

    "This ticket is subject to the rules and regulations of the football Association and npower Football League"

    I don't have my season ticket book with me but I would assume it says something along the same lines

  • could you put stuff up there and just not put the tags on it? then just send links to your mates so they can view it, but don't mention what it is? can they then not search for the footage?

    It wouldn't help your hit count, but if you still wanted to record matches and show your mates you could prob get away with that?

    As long as it says that, it's down to you to look up the rules. That's the law.
    I think the rules have to be provided upon request when you purchase the ticket. So if you buy online they can provide a link, but if you do it over the phone or at the ticket office you have to have an opportunity at the time of agreeing to the terms (i.e. when completing the purchase) to view said terms. If you are at the ticket office window and about to hand over your cash, which is acceptance of the terms according to the ticket, then it's surely your right to have a copy of the terms, they can't send you away and say go find out for yourself.
  • To be honest it's the priciple. There were only three little clips on there , it wasn't as if im someone who has their own channel and post clips every week. I cant be arsed with the rules - I don't do Rules . I'm going to take some video at Stevenage now and put it on Youtube and see if they delete my account.

    yep, i meant to put - and don't put the match title in the title header. call it something completely random and just link it to your mates.

    eg - 'south east london versus recently promoted hertfordshire team'

    Considering there were no Championship games and that the FLS was presented from the Valley last week you'd think we'd have got slightly more than the obligatory 60 seconds that we always get.

    Goldrange haven't been employed at The Valley for about 10 years . . .
