Our ongoing legal disputes with Palace

edited December 2006 in General Charlton
Worst case scenario

It all goes to court, we are shown to have acted foul of the rules and are given a points deduction.

Will this come into effect this season or next season ?

I don't think this has got anything to do with the FA - it's a contractual dispute between Dowie and Jordan alone, despite the Tango man's bluster.

i think you're being naive mate if you think that is the real purpose of the legal action.

It could drag on beyond that, at which point the FA might want to take a view on what's gone on, but at the moment all that is at risk is pride and money.

Incidentally, there was supposed to be a preliminary hearing this Wednesday. If it goes to a full hearing, we'd probably still have to wait a few months, so it might not even take place this season.

It's irrelevant, this is a civil case brougtht by Jordan and not the FA - two separate entities.

Since when has the FA made sense?

However, if it were to come out in the civil case that we had made an illegal approach for Dowie while he was still at palace, surely the FA would have to investigate it as a breach of their rules.

Yes, but we likely would get away with a fine/suspended sentence. When Ashley Cole was tapped up there were no points deductions, I can't see them imposing a points reduction on us for a first time offence.

Preliminary case opens today: from the Telegraph

Crystal Palace chairman Simon Jordan's High Court battle with Iain Dowie starts today with Dowie possibly facing a judge's order to reveal the exact details of his switch from Palace to Charlton in May.

Crossing Jordan: Ian Dowie (r) is being sued by his former chairman
Jordan is suing his former manager for £1 million for fraudulent misrepresentation after allowing him to leave to be near his family in Bolton.

Dowie joined nearby Charlton eight days later but was sacked last month after a disastrous six-month reign. He has always maintained that he did not set out with the intention of joining Charlton when he left Palace. Jordan's legal action starts in a preliminary High Court hearing today, in which he will ask a judge to order Dowie to disclose when and how Charlton first contacted him.

The case, one of the most bitter legal fights in Premiership history, promises to be highly revealing about what goes on behind the scenes at the top of English football.

Jordan said: "Dowie's lawyers have asked me 350 questions but we've asked him a small number of questions and he's refused to answer a couple of them.

"We're going to court to get an instruction to answer. The questions concern a number of things around when he was first contacted and by what method."

Jordan, who has already announced plans to sue Charlton separately in connection with Dowie's departure, wants to force the club to disclose when they first approached Dowie. "We will make an imminent application to join Charlton to this case as they were privy to certain things," Jordan said.

"I would imagine that application is about when Dowie or his agent were approached and documentary evidence of that."

Jordan is furious with Dowie for the manner in which he left Palace. He will claim the coach had greater responsibility to the club, although Dowie's lawyers are expected to submit a counter-claim.

A Charlton spokesman said: "The hearing is the preliminary reading of the cases by the barristers to the judge. No further information can be given."

Dowie's lawyer was unavailable for comment and neither Dowie nor Jordan are expected in court today. The full case is due to be heard next summer.
