    Possible. But the chances are that given the circumstances the crash apparently happened in even if the pilot were somehow to have got out first and jumped he probably isn't going to have made it very far from what I can see.

    Had he done that, it wouldn't have been a runner he did, rather a swimmer in stormy seas!
  • When you put everything together, an old banger of a plane, a pilot lacking in the qualifications for this sort of flight, extremely poor weather conditions and flying over water. Maybe if you took any one of those factors out, all would have been well, but all four together was probably too much.

    Exactly, this is why there are regulations , and when those regulations are flouted someone needs to end up in the clink for manslaughter, and clearly that someone isn't the hapless pilot, regardless of the fact that he has passed away and cannot assist investigations.

    He also shot JFK and planned 9/11 on the way down.
    If he had all that time he could have had a look for the ball Nicky Bailey took his penalty with.

    Seems that is still not clear and the £5.3m payment might be just the first installment which they were due to pay - they may have to pay the balance.

    The article says the second installment is due in January 2020 so it looks like the full amount might need to be paid?

    I remember reading somewhere (possibly a Gladwell book called Outliers) that there tends to be around seven crucial factors to lead to a crash. Any single issue on it's own is unlikely to be critical.

  • Ahem. Agree with all the above comments, but what about the agent's fees trousered by the McKay clan? Nobody is talking about that.

  • Cardiff are not coming out of this at all well. Basically refusing to pay and instead claiming that Nantes owe them for damages!


    Cardiff City face a three-window transfer ban if they fail to pay Nantes the first installment of the £15m fee for striker Emiliano Sala.

    Fifa has released the full reasons for its September ruling ordering Cardiff to pay the first 6m euros (£5.3m).

    Cardiff will lodge an appeal against the decision in the next two weeks to the Court of Arbitration for Sport.

    The Championship club have argued they were not liable for any of the fee because the Argentine was not officially their player when he died.

    The world governing body's players' status committee (PSC) ruled Cardiff must pay the sum "corresponding to the first installment due" in the transfer agreement and rejected the Welsh club's arguments on a variety of grounds.

    The PSC report reveals Cardiff had sought to delay Fifa's judgement until possible civil and criminal proceedings, as well as an Air Accident Investigation Bureau investigation had been concluded.

    They also argued Nantes would be "liable" for damages to them over the fatal flight, which was booked by Willie McKay and his son Mark, who was employed by the French club, to find a buyer for the player.

    Just to clarify he had a license however it did not cover that plane at night in the dark.

    For small aircraft you can hold a VFR licence which stands for Visual Flight Rules or an IFR licence which stands for Instrument Flight Rules.

    Visual Flight Rules mean you are licenced to fly the plane using  a minimum of the planes instruments and a lot of looking out the window using the ground as a reference. Instrument Flight Rules mean you are 100%  using the planes instruments as you cannot see anything out the window.

    Sadly this has all turned out as I expected.  Hopefully the CAA will finally act to close the loophole that allows pilots without CPL/ATPL licences to carry passengers on the pretense that they are "cost-sharing" and not being paid. 

    Tragic and entirely pointless and avoidable deaths.

    The plane carrying 28-year-old Sala and pilot David Ibbotson from Nantes to Cardiff crashed into the English Channel in January 2019. 

    David Henderson, 60, pleaded not guilty at Cardiff Magistrates' Court.

    The full inquest at Bournemouth Coroner's Court was adjourned until the trial in 2022.

    I don't think they have. FIFA ruled they had to pay it but then Cardiff appealed to CAS and the hearing last year was delayed.
