Buildings Insurance Question

I own and rent out a 1st floor flat in the UK. Last year the washing machine went wrong and the result was the kitchen in the ground floor flat needing a new ceiling and new lighting. I made the claim, I sourced the 3 quotes and I paid the £250 excess. Over Christmas the waste trap from me bath in my flat appears to have been leaking causing the same damage and I’ve asked the freeholder for another claims form, but they are now saying that it is down to the owner of the ground floor flat to make the claim. My question is, am I liable to pay the £250 excess? The freeholder says it has nothing to do with me………..
